We won!  The judge has thrown out the Plaintiff’s lawsuit, granting the Motion to Dismiss.  The Plaintiff has already promised to appeal, so this is not over yet.  The next step is the First Circuit and then to the U.S. Supreme Court.  If you would like to read the opinion and some related media coverage, click here.

Attorney Simmons served as local counsel to the Alliance Defense Fund in a lawsuit against a school district who denied a Christian mother access to the “Friday Folder” where organizations send home information to the children about community events. This mother wanted to pass along information about Vacation Bible School and was refused simply because she was a Christian. After we filed suit, the school district settled and paid our attorney fees. A copy of the check sits proudly displayed in his office.

Attorney Simmons, along with Co-Counsel, defended two clients who were arrested for street preaching on Hampton Beach. They broke no laws and were only exercising their constitutional rights. We went to trial and our Motion to Dismiss the matter was granted after the State’s case and before we had to put on a single witness.
